Data protection in Hong Kong is governed by the Personal Data Protection Ordinance (PDPO). The law defines personal data as information that can identify an individual, establishes data subject rights and specific obligations to data controllers, and regulates the collection, processing, holding and use of personal data through six data protection principles. It also prohibits the unauthorized disclosure of personal data, commonly known as doxxing.
Moreover, the law requires that data users must notify data subjects of any transfer outside Hong Kong of their personal data to a third party, or between two entities both controlled by a Hong Kong data user. It also requires that data exporters take legal advice before agreeing to any contractual arrangements with data importers, particularly in respect of any provisions relating to cross-border transfers of personal data.
In addition, the law states that a data user must ensure that any transfer of personal data outside Hong Kong is in accordance with the PDPO. This requirement is often referred to as the “fair processing principle” and imposes additional obligations on the data user.
It’s important to note that the data protection laws in Hong Kong are constantly evolving, with significant changes in 2012 and 2021. Those amendments primarily focused on enhancing transparency and consent requirements around direct marketing and preventing the dissemination of personal data without a legitimate purpose.
A key driver of these changes is the increasing recognition that data can offer business value in the form of insights, analytics and services. However, the data landscape is increasingly complex and requires a more holistic and integrated approach to management. As a result, many companies are moving towards a data mesh architecture. This involves adopting new ideas, such as thinking of data as a product that fulfils a “job to be done”, and introducing strong federated governance models.
